Transcript of part of audio from extraordinary meeting of Cessnock Council, 10 September 2014.

Mayor Pynsent:
So, we move on to PE115. Moved, Councillor Maybury.

Second, Councillor Hawkins.

Councillor Ryan.

Councillor Ryan:
May I ask some questions, Mayor Pynsent? So um obviously to the um Director of Planning, um my, my understanding ... Can you tell me if I am correct in understanding the big picture of this?

There is a condition there that says a Traffic Management Plan has to be submitted and reported to council 28 days prior to the event. A traffic management plan was submitted and was found to be inadequate. So consequently, further negotiation went on. um A traffic management plan which was adequate, which is adequate in the council office's opinion has been submitted. And it's now less than 28 days to the event and consequently, there's a section 96 application to, to change that condition of consent to um whatever those words crossed out there ... not less than. So ...

Mayor Pynsent:
Yep, so that's the question?

Councillor Ryan:
Uh, yes, the start of the question. So if ... If the council were to not approve this section 96 application, there is still a Traffic Management Plan? The council officers have still suggested that it's adequate in their opinion.

It would be unreasonable for the Council not to allow the event to go ahead, because for all practical purposes they've achieved the conditions that the council has put on them and the event is eminent.

Why, why, why are we going to this extent of holding an extraordinary meeting to approve a plan when the event could proceed anyway?

Mayor Pynsent:
Director.

Director:
Uhm, thank you um. Firstly, in relation to the context you provided, that is correct. Uhm, in terms of the, er I guess the extraordinary meeting, that's an issue that I, I guess council has decided in relation to they wanted to call an application to have an enough time before the event to have a look at the issues. I think that, that's my understanding.

Councillor Ryan:
So, so Councillors called this extraordinary meeting?

Mayor Pynsent:
That's correct.

Councillor Ryan:
Er, can we, do we  ... Can we ... Do we know ... Can you tell us who?

[inaudible]

Mayor Pynsent:
Yep.

Director:
I, I, I personally can't tell you the exact Councillors who signed the call up.

Councillor Ryan:
The conditions say it needs to be be reported to a council meeting, that someone has obviously called this extraordinary meeting.

Mayor Pynsent:
That's right.

Director:
Mr. Mayor, the two councillors you need two councillors on a code of meeting contact Code of Meeting um Practice um Councillor Stapleford and Councillor Campbell.

Mayor Pynsent:
Okay? No further debate or no debate? I'll put the motion. Those in favour ... Councillors Gibson, Troy, Dougherty, Hawkins, Campbell, Maybury and Pynsent. Those against? Councillors Wrightson, Olsen, Ryan, Stapleford and Smith.

Mayor Pynsent:
So move on to PE 116. Moved Councillor Troy. Second to the Traffic Management Plan, Councillor Campbell.

Councillor Wrightson.

Councillor Wrightson:
Thank, thank you Mayor Pynsent. Look, it's it's just something that I have noticed er trying to flick through this Traffic Management Plan. I wanted to go through and have a look with the risk assessment  which is er listed here in the contents as number 11 and when I flick through to number 11, er it's described within the document has something else. Sorry, my apologies. [inaudible] Okay, if we looked at three Vigilant Safe Services, that's described within the document as item number 2 so I'm a b.. I'm a bit confused with this Traffic Management Plan. I mean, is it .. is it correct? Do we have some other errors?

[inaudible]

Okay, sorry, yeh well ... Doesn't have page numbers but It.. Item 3 the, the TMP is listed in the co.. content page, it should be four. I mean it's just messed up so I am just wondering how much effort has gone into this document looking at er... You know, they can't even get something so simple right?

Mayor Pynsent:
The director?

Director:
Um, Thank you Mayor. Um, Councillor Wrightson, I think that might be a formatting error. That's my only response to that. The rest of the um.. Traffic Management Plan appears to be in sequence.

Councillor Wrightson:
Okay, so, so the document that we are looking at Director the document that has been assessed by Council officers in its entirety?

Director:
Through you Mayor, that's correct

Councillor Wrightson:
Thank you.

Mayor Pynsent:
Councillor Troy?

Councillor Troy:
Yeh, thanks Mayor Pynsent. I'm happy to er.. to move that this be approved. I'm glad to see a comprehensive Traffic Management Plan has been put forward and, and er will be approved tonight. I'm er looking forward to this being a [cough].. an event that.. that has no hiccups.

Er that the locals will see... er there were no er fears to be had after all. I do note that there has been some mischief caused by a Facebook group called Millfield Residents who are threatening to be out Kangaroo shooting and.. and er the like over the weekend. It is quite an extensive list of things that they have included. Er and I just think it's disappointing that possibly one or two people give the..  the Millfield residents, the actual Millfield residents who are very supportive of this event a bad name and that's.. that's just a.. an absolute shame. Nevertheless, er.. I'm.. I'm glad to see this Traffic Management Plan come tonight and er and go forward from here.

Mayor Pynsent:
Councillor Wrightson?

Councillor Wrightson:
Sorry. Thank you Mayor Pynsent. Just, just one other question. um Is it the General Manager's intention to have Development Compliance Offices in attendance during this event?

Mayor Pynsent:
Director.

Director:
Oh, thank you Mayor Pynsent. um Councillor Wrightson, we.. we will be discussing availability of staff during that event. Ah, I can't.. I don't know off the top of my head if our people are able to attend at this stage.

Councillor Wrightson:
Alright then, so..

Director:
Eh complaints are able to be lodged with the Council if there are issues because it starts during the week..

Councillor Wrightson:
OK so.. so what.. what would happen if um say an adjoining property owner and had.. had um some concerns and it was was clearly evident to them that um one of Councils conditions of consent was not being complied with? What would that resident do in that, in that particular situation? Would would they contact the police? Would they contact Council?

Mayor Pynsent:
The Director?

Director:
Thank you, Mayor Pynsent. Um Councillor Wrightson, that.. that's correct. Council doesn't traditionally have staff working on weekends in Development Compliance. It's like all other activities across erm businesses that operate on weekends. Er they can either contact Council first thing on the next business day or if it's a serious issue they can also contact the police.

There will be police um... I think it's User Pays police that will be provided at the event and my understanding is there's also contact list of people to contact in that regard um if residents have an issue.

Councillor Wrightson:
Thank you.

Mayor Pynsent:
Councillor Campbell

Councillor Campbell:
Yeh, thank you Mr. Mayor. Um I er moved when, when this originally came up that it should come back to the full Council to er to approve er for the reason that I thought given the strength of some of the public opinion that it would be worth giving in as much scrutiny as possible.

Um that bringing it up like this, this has given the public an opportunity to see it as well. Um.. I, I think it's a very strong Traffic Management Plan er for the event; er I think it's very strong.

Um it's important that the Council's staff have recommended that we approved it. Er I'm not an engineer so it's heartening to know that the engineers believe that this will be er sufficient. Erm it seems to me that with traffic marshals in radio communication at the top and bottom of Mount View holding and releasing vehicles.

Um I, I think that's.. that's very strong, in fact it was mentioned to me by somebody that that was the sort of thing more commonly associated with road works than with a music festival. Erm so this is probably stronger er than it might have needed to be by the letter of the law, so I think that's very good er and I feel very confident in supporting the Traffic Management Plan and the event. If I didn't, I wouldn't be voting for it.

Mayor Pynsent:
